Buyer Broker Cooperation Fees
-Broker commissions and compensation to the Listing Agency, as well as offers of compensation to the Buyer’s Agency and/or Broker’s Agency, are fully negotiable and not set by law.
-All offers of compensation to the Buyer’s Agency or Broker’s Agency are now removed from the MLS, with no references allowed. Listing Agencies/Agents can still offer compensation for their own listings through other means.
-Any compensation offers from the Listing Agency or Owner to another broker, agent, or representative for the buyers must be clearly disclosed and approved by the Owner.
-Consumers can still negotiate compensation off-MLS with real estate professionals. The settlement does not alter the ethical duties of NAR members, who must always protect and promote their clients’ interests and treat all transaction parties honestly (Article 1, COE). NAR members will continue to use their skill, care, and diligence to safeguard their clients’ interests.
